The Digital Services Act: A New Legal Framework for the Digital Age

The Digital Services Act has been in effect in Germany since May 14, 2024. This legislation, initiated by the federal government, marks a significant step forward in the regulation of digital services and establishes clear guidelines for their operation and oversight.

Background: The Digital Services Act (DSA) and the Need for the Digital Services Act

Digital services offered by platforms and search engines have become an integral part of daily life. However, their growing importance also brings new challenges regarding security and legal compliance. In Europe, the Digital Services Act (DSA) is already in place, requiring digital service providers to combat illegal content. Large platforms and search engines have been required to comply with the DSA since August 25, 2023. To establish clear regulations for smaller operators as well, the Digital Services Act was developed.

The Digital Services Act in Detail

The Digital Services Act was passed by the Cabinet on December 20, 2023, and received the approval of the German Bundestag on March 21, 2024. On April 26, 2024, it was approved by the Bundesrat and finally entered into force on May 14, 2024. This legislation establishes the legal basis for German authorities to enforce the DSA even against companies subject to German oversight.

Coordination Office for Digital Services and Complaint Management

The independent Coordination Office for Digital Services within the Federal Network Agency plays a central role in this regard. It monitors compliance with DSA requirements and is also responsible for imposing fines for violations of the rules. Users can contact this agency directly to file complaints related to digital services. The German Bundestag has even decided that the Coordination Office should establish an easily accessible and user-friendly complaint management system.

Fairness and Transparency for Commercial Users and Protection of Minors

Furthermore, the Federal Network Agency ensures fairness and transparency for commercial users of online intermediary services and search engines. The DSA also contains guidelines for advertising on online platforms to ensure that certain personal data is not used for commercial advertising. The protection of minors in the digital space is monitored by the Federal Center for the Protection of Children and Youth in the Media.

Combating online crime

The Federal Criminal Police Office (BKA) also plays an important role under the Digital Services Act. It receives reports of suspected online crimes and investigates criminal content. At the initiative of the German Bundestag, the federal government is required to submit an annual report on the nature and number of such reports received by the BKA—beginning June 30, 2025.

Conclusion

With the entry into force of the Digital Services Act, the Telemedia Act and the majority of the Network Enforcement Act will become obsolete. Instead, existing requirements will now be directly regulated by the DSA or the Digital Services Act. This marks an important step toward making the digital world safer and legally sound.
