The main purpose of the bonus is to provide financial relief to employees in the face of inflation. Although this purpose is established by law, it is not interpreted strictly. This means that the bonus is not strictly tied to specific conditions. Employers therefore have some leeway in how they handle the bonus.

Differentiation among employees

Not all employees must receive the same inflation adjustment bonus. Employers may differentiate as long as there are objective reasons for doing so. Some factors that can be considered include:

  • Active employees: According to the Lower Saxony Regional Labor Court, it is permissible to pay the bonus only to employees who are currently actively working for the company.
  • Loyalty to the company: The Stuttgart Labor Court permits linking the bonus to future loyalty to the company. However, it must be ensured that employees with fixed-term contracts are not disadvantaged.

Practical Tips for Employers

It is important for employers to grant the bonus correctly and on time. Here are a few tips:

  • Timely payment: The bonus must be paid by December 31, 2024, at the latest, to ensure tax-exemption.
  • Additionality: The bonus must be paid in addition to the regular salary. Replacing benefits already contractually agreed upon, such as a Christmas bonus, is not permitted.
  • Generosity: In case of doubt, employers should err on the side of including a broader group of eligible employees. This can help avoid damage to both internal and external reputation.
