The relationship between landlord and tenant isn’t always the best. Especially when problems arise with the apartment, one or the other resident may seek a rent reduction. Although landlords are legally obligated to maintain the apartment in a condition that allows for trouble-free living, issues do arise that can be financially addressed through a rent reduction. When can I reduce the rent?
In principle, a rent reduction can be claimed from the moment a deterioration in the quality of living occurs. This is because the so-called right to a reduction takes effect automatically as soon as a defect becomes apparent. However, it is advisable to first seek dialogue with the landlord or the property management company. A rent reduction should only be sought if all attempts at communication fail.
What are the first steps?
If a defect occurs in the rental apartment, you are legally obligated to inform the landlord as soon as possible. A defect report is therefore the first step, as it gives the landlord an opportunity to resolve the problem. If this is not the case, the second step should be to issue a written notice of rent reduction. The letter should document the reported defect in writing and specify a percentage reduction in rent. The time between the defect report and the notice of rent reduction should not be too long, as this could raise doubts about whether the reduction in living quality is truly that significant.
How much can a rent reduction be?
The extent of financial compensation depends on how severely you are affected by the issue in question. A real-world example: A leaky drainpipe in a sink, for instance, entitles you to a rent reduction of two percent (ruling by the Berlin Regional Court). However, if foul-smelling sewage backs up due to a blockage in the pipe, the rent may even be reduced by 38 percent. It is not possible, however, to make blanket statements regarding the specific amount of the reduction.
