How to Write a Will Correctly

INHERITANCE LAW SETS FORTH SPECIFIC REQUIREMENTS

What testators need to consider if they wish to bequeath their assets in a manner different from that provided by law.

THE HOLDSCRIPT WILL

As the name implies, a holographic will must be written entirely by hand—from the first letter to the last—and signed. You should sign with your first and last name to avoid any confusion about who made the will. It is also recommended to note the date and time. This is important because a new will can revoke the old one in whole or in part.

THE NOTARIZED WILL

A notarized or public will is certified by a notary, so you only need to sign it. This form of will is therefore useful if you have difficulty writing due to age or illness.

THE JOINT WILL

Married couples or partners in a registered civil partnership can also create a joint will. It is written by one of the partners in their own handwriting and then signed by both partners, with the place and date indicated. A special type of joint will is the so-called “Berlin will.” In this case, the partners name each other as sole heirs and stipulate that the surviving partner is to be succeeded by one or more children.
